3.Ten Authorities Issue Measures to Regulate AI Technology Ethics Review and Services

Recently, the Ministry of Industry and Information Technology (MIIT) and nine other authorities jointly issued the Measures for Ethics Review and Services in AI Technology (Trial Implementation). The document provides, among others, that for AI technology activities involving deep synthesis, algorithm recommendation, and generative artificial intelligence service management, which are subject to registration, filing, and administrative approval, and for which compliance with technology ethics requirements is a condition for approval and a regulatory content, expert review will no longer be required. The document took effect on the date of issuance.

Recently, the General Office of the Shanghai Municipal Government issued the Work Plan for Enhancing Policy Disclosure and Comprehensively Improving Government Transparency in Shanghai. The document calls for the establishment of a citywide unified policy release platform. It aims to enable centralized, unified, authoritative, and dynamic release of policy by administrative organs at all levels across the city, and enable “One-Stop Search” for policies across departments, levels of government, and regions.

2. Shanghai Issues Several Measures to Further Strengthen Full-chain Supervision of Food Safety

Recently, the General Office of the Shanghai Municipal Government issued the Several Measures on Further Strengthening Full-chain Supervision of Food Safety. The document puts forward twenty-eight measures from nine aspects including strengthening quality and safety management for both the source and market access of edible agricultural products, innovating the licensing for food production and operation and the ex ante and ex post regulation models, and improving the comprehensive supervision mechanism for catering services.

Recently, the MOFCOM, together with several other authorities, issued the Guiding Opinions on Better Serving the Real Economy and Promoting the High-quality Development of E-commerce. Could you please brief us on the relevant content of this document?
A
E-commerce is an important component of the digital economy, characterized by rapid development, vibrant innovation, and extensive application. China has remained the world’s largest online retail market for 13 consecutive years. Better serving the real economy is the original mission and essential purpose of high-quality development of e-commerce. The Guiding Opinions aims to stimulate the endogenous driving force, innovation potential, and openness vitality of the development of e-commerce, so as to better serve the real economy. It has three main features.
First, it aims to deepen the integration of the digital and real economies.With the empowerment of the real economy as the main thread, we will further leverage the unique advantages of e-commerce in connecting production and consumption, online and offline activities, urban and rural areas, and domestic and international markets. The document proposes to strengthen innovation-driven development, advance “AI + e-commerce”, and deepen the application of digital technologies. We will cultivate high-quality e-commerce, promote online-offline integration, develop rural e-commerce and industrial e-commerce, and promote efficient collaboration of industrial and supply chains. These measures will guide e-commerce to shift from “scale expansion” to “quality improvement” and provide new driving forces for the development of the real economy.
Second, it aims to expand opening-up and cooperation.The Guiding Opinions benchmarks against high-standard international economic and trade rules, explore the establishment of pilot zones for “Silk Road E-commerce” cooperation with an expanded scope, and further step up pilot reforms. We will deepen international cooperation on e-commerce, expand the circle of friends for “Silk Road E-commerce”, and continue to carry out themed activities such as “Silk Road E-commerce Benefits the World”. By creating “one signature product for each partner country”, we will turn China’s enormous domestic market into tremendous opportunities for the world.
Third, it aims to foster a win-win ecosystem.The Guiding Opinions pursues a coordinated approach that both promotes development and strengthens regulation. On the one hand, it includes promotional measures such as highlighting model cases, strengthening quality leadership, and improving public services. On the other hand, it sets out regulatory requirements such as strengthening routine supervision, promoting industry self-discipline, and guiding compliant overseas expansion. These efforts are designed to foster a sound ecosystem for mutually beneficial cooperation between domestic and international markets, harmonious coexistence between online and offline businesses, and win-win development among e-commerce platforms, operators on the platforms, and workers.
The MOFCOM will continue to work with relevant authorities to ensure the implementation of the Guiding Opinions, so as to better contribute to high-quality economic and social development.

Interpretation of the New Foreign Trade Law (I): Advancing the Building of a Trade Power through Institutional Opening-up

Article Abstract
This series focuses on interpreting the key institutional arrangements laid down in the new Foreign Trade Law of the PRC that have a tangible impact on improving compliance in foreign trade work, safeguarding national sovereignty, security, and development interests, and protecting the lawful rights and interests of foreign trade operators. It aims to provide both practical and forward-looking guidance for government departments in carrying out relevant work and for enterprises in engaging in foreign trade activities. In this article, we first introduce the trade policy compliance mechanism established by the new Foreign Trade Law of the PRC and the authorization for countermeasures against specific overseas entities.

II. Establishing a Trade Policy Compliance Mechanism to Honor China’s External Commitments
Article 7 of the new Foreign Trade Law of the PRC provides: “The state shall establish a trade policy compliance mechanism aligned with internationally accepted rules. When formulating policy measures related to foreign trade and intellectual property rights connected with foreign trade, departments of the State Council and the people’s governments at or above the county level and their departments shall conduct trade policy compliance assessment in accordance with relevant state regulations.”
1. Evolution of China’s Trade Policy Compliance Work
The trade policy compliance mechanism is not a “new” mechanism created by this amendment, as China had previously introduced relevant regulations.
At the level of national legislation, the new Foreign Trade Law of the PRC establishes the trade policy compliance mechanism as a formal institution in the field of foreign trade, in order to further strengthen the compliance of central and local government policies related to foreign economic and trade activities. This new provision indicates that China will continue to take a proactive approach to the compliance control of trade policies, shifting from a focus on “ex-post responses” to “ex-ante assessment and prevention”. As an important measure to expand institutional opening-up, the trade policy compliance mechanism helps urge governments at all levels to exercise prudence when formulating trade policies, comply with and fulfill China’s international obligations, and avoid undue disruption to foreign trade market order, thereby providing enterprises with a better business environment and reducing the risk of trade disputes.
2. A Brief Analysis of the Trade Policy Compliance Mechanism under the New Law
From the perspective of the scope of compliance assessment, the new law confirms that any policy measures related to foreign trade and intellectual property rights connected with foreign trade fall within the scope of compliance assessment. Pursuant to the Implementation Measures, compliance assessment is treated as a necessary precondition before the introduction of any trade policy. When submitting a trade policy for approval, the competent authority must submit a compliance assessment opinion at the same time. If there is a risk of inconsistency with WTO rules, the policy-making authority shall revise the draft policy and explain the revisions in the submission materials.
From the perspective of the basis for compliance assessment, the current working documents require assessments to be conducted against the relevant WTO rules and China’s accession commitments set out in the WTO Agreement and its annexes and subsequent agreements, the Protocol on the Accession of the People’s Republic of China, the Report of the Working Party on the Accession of China, and other documents. These cover disciplines such as market access, non-discriminatory treatment, prohibited subsidies, and transparency in areas including trade in goods, trade in services, intellectual property, and foreign investment. On this basis, the new Foreign Trade Law of the PRC further requires the establishment of a trade policy compliance mechanism “aligned with internationally accepted rules”, thereby leaving institutional space for the future expansion of assessment criteria to other emerging economic and trade agreements to which China is a party, which reflects the forward-looking nature of the legislation.
It is also worth noting that, in addition to proactively conducting compliance review of trade policies it formulates, pursuant to Article 12 of the Implementation Measures, where a department of the State Council or a local government believes that another WTO member has adopted measures in violation of WTO rules, it may also notify MOFCOM through relevant channels. Upon assessment, the MOFCOM may raise concerns about the measures taken by the WTO member in question, actively engage in consultations and negotiations, and safeguard enterprises’ legitimate overseas interests. Article 53, paragraph 2 of the new Foreign Trade Law of the PRC also provides that the competent department for foreign trade under the State Council may, as needed, conduct assessments of the trade policies of relevant countries or regions.
Implications
For enterprises, the trade policy compliance mechanism will further enhance the fairness and rationality of relevant government policies, improve the predictability and stability of the business environment, and ensure equal treatment of domestic and foreign-funded enterprises. In addition, in line with the spirit of the Implementation Measures, if an enterprise suffers harm to its overseas interests as a result of measures in violation of WTO rules adopted by another WTO member, it may also promptly report the situation to the relevant authorities, which may then raise concerns with the WTO member through multilateral channels.
